This paper runs through the theological tenets of the Dominican friar Francisco de Vitoria, considered the father of international law , who makes the legal bases of the European colonialist enterprise and what would be done -in below- modern law.The aim is to recognize the constituent elements of legal order that gives support to the conception of Amerindian populations constructed from the sixteenth century, which is a continuum in the conceptions of modern law.
