Abstract

The Organic Law 2/2020 modified the Spanish Penal Code prohibiting judicial authorization of the sterilization of disabled people, confirmed by the Constitutional Court in 1994. This work analyzes the impact of the International Convention on the Rights of Persons with Disabilities in this penal reform and also in the new civil regime for mental disability, that replaces the representation system with that of support for the disabled person in their decisions. Both the Convention and the Civil Code accept exceptional representation in serious cases, but the penal reform has rejected it, absolutely prohibiting sterilization in cases of absolute disability. The work analyzes the principle of non-discrimination and the criminal consequences of the new situation, from a critical perspective
