Abstract

The Spanish legislator handles the small offenses against propertyas mere “symbolic” Criminal Law and continuous reforms have notchanged that. Recently, article 234.1 of the Penal Code has been changedand now the reiteration of lacks becomes a crime; but this provision doesnot work. The reason for this lack of effectiveness is that this kind ofoffenses (small thefts) must be considered as mere lacks and according toLaw 38/2002 of 24thOctober they must be judged immediately (fourteendays maximum). Even so, in the Criminal Code there are another suitablemechanisms and must be also considered that the appropriate solutionto these offenses is not necessarily a criminal answer.
