Abstract

An issue that has caused rivers of ink among civil lawyers since the enactment of the Mortgage Law is whether registration in the Spanish State is constitutive or merely declaratory. Some reasons would justify modifying the current rule. But, even without doing so, if we consider the irritating effect of not registering, we can understand those who defend that registration is quasi-constitutive in all cases. More than a legal change, a change of doctrinal mentality is needed in this respect.
