Abstract

The obligation of reciprocal fidelity between spouses is one of the most relevant duties of marriage and stable union, and has been disciplined by Brazilian law for more than a century. However, the maturation and social transformations have brought enormous changes in family relationships and it is relevant to examine if there would still be sanctions to be imposed on those who fail to comply with this legal duty. The theoretical and analytical development of this research was undertaken by means of a hypothetical-deductive scientific method, with general concepts being presented, about which, in a second moment, hypotheses about the existence of sanctions and their limitations were tested. The research has an eminently theoretical character in order to contribute to the development of legal-scientific reasoning, having been analysed the positions of eminent authors and decisions made by the higher courts on the subject to encourage reflections. The hypotheses presented were confirmed.
