Abstract

The present work investigates the incidence of organization and distribution rules oncompetence regarding the compliance with health service market. The issue will bediscussed with special reference to four EU countries: Germany, France, England andSpain. On the one hand, one may say that the first two countries adopt the occupationalmodel systems. Nevertheless, while Germany embodies decentralization of competence,France centralizes the competences. On the other hand, England and Spain adopt a ‘universalistic’ model system. nevertheless, while England centralizes, Spain decentralizes thecompetences. Moreover, the paper takes the operators and financial backers market intoaccount, and this occurs in order to figure out EU legal system effects on it. as to thispoint, The perspective of legal system competition is of particular significance.
