Mecanismos sancionatorios alternativos al proceso penal. Una visión desde el Derecho inglés.

Abstract

During 2015, the Spanish legislature approved two legislative reforms through which further opened the possibility of considering the creation of alternative mechanisms to criminal proceedings. In this paper, on the basis of the elimination of criminal offenses and creating new criminal proceedings for payment, alternatives to existing criminal proceedings in comparative law are analyzed and, in particular, in the English legal system. Thus, it will show the different alternatives and the various problems encountered in its implementation. Finally, it is proposed a draft proposal for the creation of an alternative mechanism to criminal proceedings in Spanish law applicable against first offenders and whenever slight or minor offenses.
