Abstract

Transfer of technology is a process where it is possible to find factors of diverse nature, for example, patent and trademark rights. It is about intellectual creations with considerable value, such as, patents, industrial designs, know-how (in this case there are not exclusive rights but the commercialization is possible) and trademarks in relation with them. In the international context it exists different ways to regulate transfer of technology: concurrence laws and contractual laws. In this field, Cuba has not a great development, but it is possible to find different areas in the juridical system, such as, patent and trademark rights, investment law or economical contractual law.
