Sanctions aimed at protecting victims: restraining penalty

Abstract
In this paper we will analyse the legal nature, content, conditions for application, durability, execution and breach of the restraining penalty in the Spanish Criminal Law. There are three different penalties under this name: deprivation of the right to reside in specific places or to visit them, prohibition to approach and prohibition to communicate with the victim, or with her relatives or other persons determined by the Judge or Court of Law. The aim is to identify deficiencies in its regulation and make
proposals for improving it.
