Abstract
The percentage to add in the surcharge of the benefits done due to the unfulfilment of the preventive measures must be proportional and guided by the normative criteria. The legal tests of reference are: the danger of the activities, the number of employees affected and the attitude or the behavior of the company in the preventive area.
