Abstract

Italian collective agre ements and legislative interventions in recent years force Labour Law Experts to examine the validity of consolidated principles. They affect the relationship among the sources of Labour Law. In this sense, the “Fiat case” is emblematic.
The social partners must demonstrate their ability to take advantage of the new opportunities offered by the legislator, departing from collective agreement, but also, and above all, from the law. In addition, the social partners have been invested of tasks and responsibilities coming from the para-public functions that they have to perform in case of companies crisis.
