One of the most relevant aspects of the reform introduced in the field of Criminal Law in Spain by the Organic Law 5/2010, of 22nd June, is the one related to the introduction of the Corporate Criminalliability. The legislative decision adopted implies a radical breach of the model previously existing in Spanish Criminal Law, based on the principle societas delinquere non potest. The paper analyses the main characteristics of the system adopted in the field of Corporate Criminalliability by the Spanish legislator, and proceeds to point out the doctrinal arguments which justify the adoption of the mentioned rule of law.
