Abstract

The object of this paper is to present an overview of the current situation of the criminal liability of legal persons in the Chilean legal system. For this purpose, the main aspects of the law that regulates this matter, Law No. 20.393 on criminal liability of legal persons, in force since the end of 2009 in Chile, will be briefly reviewed.


The paper gives an account of the main aspects of the law, with emphasis on the system of attribution of liability to the legal person and the procedural aspects linked to mechanisms of negotiated justice.


Finally, it offers a brief overview of the probable changes that Law No. 20.393 could undergo in the short term.
