Abstract

Prison conditions, which affect the level of restriction of liberty, are linked to the evolution of people deprived of liberty in their rehabilitation process. Political-criminal trends of risk observed in recent decades have given rise to the fact that, in the evaluations of this evolution, risk assessment has an increasingly greater weight. In this sense, the use of risk assessment and management tools in the penitentiary environment and, specifically, the RisCanvi protocol in the Catalan penitentiary system, stands out. From a legal-criminal perspective, and from the concern for the respect of the fundamental rights of people deprived of liberty, this work proposes the analysis of the use of RisCanvi in the penitentiary decision making. Hence, a study is carried out with interviews to the agents that participate in the penitentiary decision making. It aims to show the reality that a criminal law with guarantees must face.
