Resumen

Los Registros de Delincuentes Sexuales son una institución implantada por diversos Ordenamientos Jurídicos para proteger a la infancia y a la adolescencia. Las prohibiciones de la inscripción registral restringen derechos fundamentales del condenado y determinan el modelo de distribución del riesgo entre el individuo y la sociedad. Tanto los ordenamientos jurídicos anglosajones como los continentales acuden a su naturaleza administrativa para defender su respeto a la prohibición de irretroactividad de la sanción y a un proceso con todas las garantías. La jurisprudencia constitucional de muchos órganos empieza a defender la necesidad de que los sistemas de registro y notificación cuenten con procedimientos de revisión del riesgo de reincidencia, especialmente en aquellos casos en los que la inscripción puede extenderse por periodos de hasta treinta años o incluso de por vida.
