“No hablo español": el idioma como instrumento de racismo institucional en el sistema penal

Resumen
Este trabajo analiza el papel del idioma como instrumento de racismo institucional en el sistema penal español. Explora cómo las barreras lingüísticas afectan el acceso a la justicia de las personas extranjeras alófonas. El objetivo es evaluar si la discriminación por idioma puede considerarse una manifestación de racismo estructural en las prácticas del sistema penal español. Para ello, se ha llevado a cabo una investigación con un diseño mixto. Por un lado, se ha realizado un análisis documental de la trasposición de la Directiva 2010/64/UE, relativa al derecho a interpretación y traducción en los procesos penales, en su incorporación al ordenamiento jurídico español, y un análisis cualitativo basado en entrevistas a 19 personas extranjeras que pasaron por el sistema penal sin dominar el español y a 42 profesionales del sistema (letrados, intérpretes y fuerzas de seguridad). Los resultados han evidenciado que existen prácticas discriminatorias a nivel macro, meso y micro, tanto por acción como por inacción, las cuales son alentadas no tanto por actuaciones (institucionales o personales) deliberadamente racistas, sino por las inercias del propio sistema y la activación de creencias estereotipadas sobre las personas extranjeras. En conclusión, el trabajo demuestra que, en el sistema penal español, el idioma puede funcionar como una barrera que perpetúa desigualdades.
