The work approaches the relation between cultural policies and cultural rights making a state of the question on some international documents of culture. It emphasizes the culturalist bias of such documents and the way in which they put in value the "cultural diversity" indicating their limitations to achieve a coherent and legitimate revaluation of the diverse expressions of groups and social minorities. It maintains, finally, that such incongruity turns out from the power of the States to define and to skirt the citizen participation, as well as of the marketization of culture and cultural diversity in the contemporary society.
