Resumen

En la jurisprudencia estadounidense, la falta de una adecuada atención a los problemas de salud mental de los presos puede constituir una violación de la Octava Enmienda a la Constitución de los Estados Unidos, que prohíbe la imposición de “castigos crueles e inusuales”. El objeto de este artículo es analizar el tratamiento que reciben dichos supuestos en los tribunales federales.
